OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm: A.) Troyer Growers, Inc. - On or about 7/16/14, employees were potentially exposed to amputation hazards from not preventing the activation of the powered sweep auger and the augers associated moving parts. Employees were working in close proximity to the moving parts of the sweep auger while performing cleaning operation inside the silo. The employee became entangled in the sweep auger when it became energized and operated. The sweep auger was not locked out. In addition, the company had not developed, documented, and/or implemented a lockout/tagout program.

Troyer Growers, Inc. - On or about 7/16/14 and at times prior thereto, employees were potentially exposed to engulfment and amputation hazards from entering confined spaces without adequate procedures, equipment, training and rescue provisions. Personnel were entering confined spaces that included, but were not limited to, corn silo equipped with powered sweep auger. The company did not develop, document, and implement a confined space program.
