OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from a 16 foot wide unstable supported platform. a) On July 18, 2014, at 4685 Sunbury Road, Westerville, Ohio, the employer did not ensure that employees not have a working platform that was 16 feet wide, supported by a rough terrain forklift with a wheel base 8 feet wide, thereby exposing employees to an approximate 21 foot fall hazard.

29 CFR 1926.451(b)(2): Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and walkway shall be at least 18 inches (46 cm) wide. a. At the worksite where employees stood on a scaffold platform guardrail and used it as a working platform, the guardrail was not 18 inches wide thereby exposing employees to an approximate 23 foot fall hazard.
