29 CFR 1910.1025(d)(6)(iii): Where the initial monitoring revealed that employee exposure to lead was above the permissible exposure limit, ; monitoring was not repeated at least quarterly and continued at the required frequency until at least two consecutive measurements taken at least 7 days apart were below the PEL and at or above the action level: On or about July 21, 2014, the employer did not ensure that when initial monitoring revealed that employee exposure to lead was above the permissible exposure limit, monitoring was not repeated at least quarterly and continued at the required frequency until at least two consecutive measurements taken at least 7 days apart were below the PEL and at or above the action level, including, but not limited to, the following: a) On May 9, 2013, a Shakeout/Dept. 30 employee's lead exposure was 81 ug/m3, or 1.62 times the permissible exposure limit, and monitoring was not repeated at least quarterly. b) On May 9, 2013, a Furnace Tender's lead exposure was 82.4 ug/m3, or 1.65 times the permissible exposure limit, and monitoring was not repeated at least quarterly. c) On May 9, 2013, a Pour Off employee's lead exposure was 59.5 ug/m3, or 1.19 times the permissible exposure limit, and monitoring was not repeated at least quarterly. d) On January 22, 2014, the Cut Off #1 employee's lead exposure was 68 ug/m3, or 1.36 times the permissible exposure limit, and monitoring was not repeated at least quarterly.
