OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees that were exposed to rack collapse and overhead struck-by hazards while working and walking in the warehouse: Location: Warehouse On or about 7/29/14, employees working at the facility were exposed to rack collapse hazards and overhead struck-by hazards in the following but not limited to areas; 1. Aisle and rack # 17-744 and 17-781: the vertical upright was twisted, damaged, bent inwards, and out of plumb by approximately 2 and 3/4-inches. 2. Aisle and rack # 17-377 and 17-411: the vertical upright was twisted, damaged, bent inwards, and out of plumb by approximately 1 and 3/8 inches. 3. Aisle and rack # 17-384: the vertical upright was twisted, damaged, bent inwards, and out of plumb by approximately 1 and 7/8 inches. 4. Aisle and rack #17-201: the vertical upright was twisted, damaged, bent inwards, and out of plumb by approximately 1 and 3/8 inches. 5. Aisle and rack #16-681: the vertical upright was twisted, damaged, bent inwards, and out of plumb by approximately 1 inch. 6. Aisle and rack #16-544: the vertical upright was twisted, damaged, bent inwards, and out of plumb by approximately 2 inches. 7. Aisle and rack #16-481: the vertical upright was twisted, damaged, bent inwards, and out of plumb by approximately 1 and 1/2 inches. 8. Aisle and rack #15-737: the vertical upright was twisted, damaged, bent inwards, and out of plumb by approximately 1 and 7/8 inches. 9. The employer was unaware that the contractor had not ensured that one of its employees was fully trained to operate a double powered pallet jack prior to contractor-assigned operation.

Location: Warehouse On or about 7/18/14, the following powered industrial trucks were left on and unattended; 1. #69 Crown powered pallet jack, 2. #8 Crown powered pallet jack, 3. #4 Crown powered pallet jack, On or about 7/23/14, the following powered industrial trucks were left on and unattended in aisles 55 and 56; 4. #39 Raymond powered pallet jack 5. #50 Raymond powered pallet jack 6. #55 Raymond powered pallet jack 7. #89 Raymond powered pallet jack Demoulas Super Markets, Inc. dba Market Basket was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1910.178(m)(5)(ii), which was contained in OSHA inspection number 968633, citation number 1, item number 3, and was affirmed as a final order on December 5, 2014, with respect to a workplace located at 875 East Street, Tewksbury, MA.
