OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by lightning:  At the construction site located on 8260 Verona Drive, Sarasota (FL), the employer failed to provide/implement a lightning warning system for employees who were exposed to the hazard of being struck by lightning while working outdoors, on or about 07/16/2014.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501.   a. At the construction site located on 8260 Verona Drive, Sarasota (FL), employees were exposed to a fall hazard in that employee was not wearing and/or provided with a fall protection system while conducting roof work 7-ft. above the ground level, on or about, 07/16/2014.
