29 CFR 1910.138(b): Selection. Employers shall base the selection of the appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the task(s) to be performed, conditions present, duration of use, and the hazards and potential hazards identified. [59 FR 16362, April 6, 1994] a. On or about July 15, 2014, in the paint department, the employer did not evaluate the performance of the gloves used by the employees when cleaning spray booths. Employees required to clean inside the booth were provided gloves that did not resist breakthrough for the entire task thereby exposing employees skin to the chemical hazards associated with solvents such as, but not limited to, xylene, 2-butoyxethanol, MIBK and Butyl Acetate .
