OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  a) Peanut Shelling Plant/Dry Storage Area -  On or about and at times prior to July 16, 2014, the employer allowed employees to operate propane forklifts without utilizing the restraint system, exposing the employees to ejection, struck-by and crushing hazards.    ABATEMENT CERTIFICATION IS NOT REQUIRED.

29 CFR 1910.178(l)(3)(i)(M): Powered industrial truck operators did not receive initial training on truck-related topics including operating instructions, warnings, or precautions listed in the operators manual for the types of vehicles that the employees were being trained to operate:   a) Peanut Shelling Plant/Dry Storage Area -  On or about and at times prior to July 16, 2014, the employer failed to ensure that forklift operators were trained in safe operations including but not limited to utilizing the restrain system when operating the forklifts, exposing the employees to ejection, struck-by and crushing hazards.   ABATEMENT CERTIFICATION IS REQUIRED.

29 CFR 1910.110(h)(12): Conspicuous signs prohibiting smoking were not posted within sight of customers served at LP gas dispensing areas:   At the propane dispensing station, on or about and at times prior to July 16, 2014, a No Smoking sign was not posted in the area by the above ground liquefied petroleum (LP) gas tanks that were used to refill portable LP tanks for the forklifts, exposing employees to a fire hazard.  ABATEMENT CERTIFICATION IS NOT REQUIRED.

29 CFR 1910.157(g)(1): An educational program was not provided for all employees to familiarize them with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting:  a) In the peanut shelling plant, on or about July 16, 2014 and at times prior to, the employer did not develop or implement an educational program to ensure that employees who were expected to use portable fire extinguishers were trained in their use, resulting in a fire hazard.
