Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to: Crushing hazards as employees were not required to wear seat belts while operating powered industrial vehicles. At the Facility - On or about 7-2-14, an employee was operating a fork truck without wearing a seat belt. The truck tipped over, throwing the operator from the truck, landing on his ankle which resulted in numerous fractures.
