29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:    Yard:    Employer did not ensure that appropriate personal protective equipment such as heat resistant gloves, eye and face protection and protective clothing was available and used while employees light the gas burner of the paint kettles on the trucks.

29 CFR 1910.1200(h)(3)(iv): Employee training did not include the details of the hazard communication program developed by the employer, including an explanation of the labeling system and the material safety data sheet, and how employees can obtain and use the appropriate hazard information:    Establishment and Jobsite:    Employer did not include in the employee training an explanation of the new label format and Safety Data Sheet (SDS) format and how to effectively access the appropriate hazard information on the updated labels and SDS's for employees who were exposed to various hazardous materials such as thermoplastic traffic paint, water-based and oil-based paint, methylene chloride, toluene, chlorinated low VOC rubber paint, and epoplex hardener.
