29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall:    (i)  Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment;  (ii)  Communicate selection decisions to each affected employee; and,  (iii)  Select PPE that properly fits each affected employee.       a. On and before 07/09/2014, the employer failed to complete an assessment of the workplace to determine what hazards were present.   b. The selection of fall protection devices (6ft lanyards and 9ft tethering equipment) used by employees tasked with completing inventory or pulling merchandise (furniture) from the warehouse area was inadequate, thus exposing employees to potential fall and/or struck by hazards.

29 CFR 1910.132(f)(1)(ii): The employer did not provide training to each employee who is required by this section to use PPE on knowing what PPE is necessary:     Employees tasked with cycle counting inventory stock items from the ware house area were provided 6ft lanyards and/or 9ft tethering equipment as fall protection devices. Employees were not informed or educated on which fall protection device to use and why it was necessary to use it for successful completion of each task.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:      At the time of the inspection, the employer did not train employees that are potentially exposed to hazardous chemicals on the revised Hazard Communication Standard (HCS) label elements and the new format and types of information on each section of the Safety Data Sheet (SDS).
