29 CFR 1903.19(c)(1): Within ten calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section:  a.  The employer has failed to submit abatement certification within ten days of the abatement date, September 24, 2014, for a violation of 29 CFR 1926.602(d) and 29 CFR 1910.178(1)(ii), issued as citation 1, item 2b, and described as follows:  Located at the site, an employee was tasked to operate a Genie telescopic boom rough terrain forklift without being adequately trained to operate the equipment, thereby exposing the operator and other employees in the vicinity to the hazards associated with forklift operation.  b.  The employer has failed to submit abatement certification within ten days of the abatement date, September 24, 2014, for a violation of 29 CFR 1926.251(a)(1), issued as citation 2, item 1, and described as follows:  Located at the site, the employer failed to remove from service defective wire rope slings that employees used to hoist steel I-beams with a Genie, model number GTH-1056, rough-terrain telescopic boom forklift and with a Grove RT600E telescopic boom crane.

29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a.  The employer has failed to submit abatement certification and documentation within ten days of the abatement date, September 24, 2014, for a violation of 29 CFR 1926.453(b)(2)(iv), issued as citation 1, item 1, and described as follows:  Located at 5955 West Broad Street in Galloway, Ohio, an employee was installing an I-beam while standing on the top rail of the guarding surrounding the operator controls on the basket of a Genie S-60 aerial lift while the employee's lanyard was tied-off to the top rail of the aerial lift's basket.  The employee was at risk of a fall hazard of approximately 40 feet due to not being tied off to the manufactured anchor point and by increasing the tipping forces of the aerial lift if a fall would occur.     b.  The employer has failed to submit abatement certification and documentation within ten days of the abatement date, September 24, 2014, for a violation of 29 CFR 1926.453(b)(2)(iv), issued as citation 1, item 1, and described as follows:  Located at 5955 West Broad Street in Galloway, Ohio, an employee was installing an I-beam while standing on the mid rail of the basket of a Skyjack SJ66T aerial lift, thereby increasing the tipping forces of the aerial lift if a fall were to occur.  c.  The employer has failed to submit abatement certification and documentation within ten days of the abatement date, September 24, 2014, for a violation of 29 CFR 1926.602(c)(1)(ii), issued as citation 1, item 2a, and described as follows: Located at the site, an employee used a Genie, model number GTH-1056 rough terrain forklift to move steel I-beams from one location to another by the means placing slings onto the tines of the forklift for a below-the-tines lift (free rigging), thereby exposing the employees to a struck-by and/or caught-between hazard if a loss of load would occur or the forklift tipped.

Located at 5955 West Broad Street in Galloway, Ohio, an employee was installing an I-beam while standing on the top rail of the guarding surrounding the operator controls on the basket of a Genie S-60 aerial lift while the employee's lanyard was tied-off to the top rail of the aerial lift's basket.  The employee was at risk of a fall hazard of approximately 40 feet due to not being tied off to the manufactured anchor point and by increasing the tipping forces of the aerial lift if a fall would occur.     b.
