OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees  a.  Located in Area A of the new build Stiles Elementary at 4700 Stiles Avenue in Galloway, Ohio, an employee was exposed to a fall hazard of approximately 12 feet while performing masonry work from a wooden pallet on the forks of a Clark, Model C500-50, Serial # 355-55-2548, propane powered industrial forklift.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.  a.  Located in Area A of the new build Stiles Elementary at 4700 Stiles Avenue in Galloway, Ohio, employees were performing masonry work off of a walk-through tubular welded frame scaffold without a safe means of access. The scaffold was not manufactured for personnel climbing, thereby exposing employees to a maximum fall hazard of approximately 12 feet.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.   a.  Located in Area A of the new build Stiles Elementary at 4700 Stiles Avenue in Galloway, Ohio, employees were performing masonry work from two separate sections of tubular welded scaffold without any means to protect the employees from a fall hazard of approximately 12 feet.

29 CFR 1926.701(b): Reinforcing steel. All protruding reinforcing steel, onto and into which employees could fall, shall be guarded to eliminate the hazard of impalement.  a.  Located in Area A of the new build Stiles Elementary at 4700 Stiles Avenue in Galloway, Ohio, employees were performing masonry work from two separate sections of tubular welded scaffold beside unprotected reinforcing steel, approximately two feet below the edge of the platform, thereby exposing employee to an impalement hazard.
