29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  Shop area - On or about July 24, 2014, the written energy control program (lockout/tagout) consisting of specific procedures, training and periodic inspections were not available for employees exposed to the hazards of moving parts when performing service and maintenance on the vertical Do All bandsaw, Haas CNC mill, South Bend lathe, and other operating equipment.

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  Entire Facility - On or about July 24, 2014, the employer did not ensure that employees allowed to operate the Komatsu's (serial No's 9902A & 030230A) forklift trucks were trained in accordance with paragraph (l).

29 CFR 1910.219(d)(1): Guarding. Pulleys, any parts of which are seven (7) feet or less from the floor or working platform, shall be guarded in accordance with the standards specified in paragraphs (m) and (o) of this section. Pulleys serving as balance wheels (e.g., punch presses) on which the point of contact between belt and pulley is more than six feet six inches (6 ft. 6 in.) from the floor or platform may be guarded with a disk covering the spokes.  Production area - On or about July 24, 2014, the South Bend lathe did not have the pulleys guarded to prevent employees from reaching into ingoing nip points.

29 CFR 1910.219(e)(3)(i): Vertical and inclined belts shall be enclosed by a guard conforming to standards in paragraphs (m) and (o) of this section.  Shop area - On or about July 24, 2014, the South Bend lathe did not have the inclined belt guarded to prevent employees from reaching into ingoing nip points.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.  Shop area - On or about July 24. 2014, the employees were not trained, in the hazards associated with chemicals such as, but not limited to,xylene and hydraliic fluid..
