29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:   a) Sub-contractor employees were using pneumatic nail guns and circular saws without eye protection exposing them to struck-by hazards, on or about 07/23/14.  For the purposes of this inspection, this employer was determined to be the controlling employer of the jobsite. The employer is being cited under OSHA's Multi-Employer Workplace Policy.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

For the purposes of this inspection, this employer was determined to be the controlling employer of the jobsite. The employer is being cited under OSHA's Multi-Employer Workplace Policy.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a) Sub-contractor employees were exposed to fall hazards of 6 feet 8 inches from wall openings on the east side where windows were to be installed, on or about 07/23/14.    b) Sub-contractor employees were exposed to a fall hazard of 10 feet from an open floor hole on the east side, on or about 07/23/14.    c) Sub-contractor employees were exposed to a fall hazard of 10 feet 4 inches from a wall opening on the west side, on or about 07/23/14.    For the purposes of this inspection, this employer was determined to be the controlling employer of the jobsite. The employer is being cited under OSHA's Multi-Employer Workplace Policy.
