29 CFR 1926.451(b)(1): Employer did not ensure each platform on all working levels of scaffolds was fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)  LOCATION: 428 Johnson Ave, Brooklyn, NY 2nd Floor.  On or about July 24, 2014  a). Employees were utilizing a single stage, welded frame metal tubular scaffold system to access the roof level of the project. Employees were not protected from falls because the working/walking surface was not fully planked in accordance with this standard.

29 CFR 1926.451(f)(15): Employer did not ensure ladders were not used on scaffolds to increase the working level height of employees:   Location: 428 Johnson Ave, Brooklyn, NY second floor.  On or About July 24, 2014;  a). Employees setting block on the roof of the above address were utilizing a single tier welded tubular scaffold with a six foot A frame ladder atop the scaffold planks to access the roof level.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:   LOCATION: 2nd floor, 428 Johnson Ave, Brooklyn, NY  On or About July 24, 2014  a). Employees were using a frame type portable ladders to access the scaffold system and then access the roof above. The ladder rails did not extend 3 feet above the upper landing surface.

29 CFR 1926.1053(b)(4): Employer did not ensure the portable ladder(s) were used for purposes for which they were designed:  LOCATION: 428 Johnson Ave, Brooklyn, NY Second floor.  On or About July 24, 2014;  a). Employees had utilized two (2) portable A frame type ladders, one ladder was leaned against the scaffold system set up on the second floor, and the second scaffold atop the scaffold planks leaning against the bulkhead to gain access to the roof.  Neither ladder was utilized in the form or manner for which it was designed.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Location: 428 Johnson Ave, Brooklyn, NY Northeast corner, roof top.  On or About July 24, 2014  a). Employees were setting concrete block at the perimeter of the roof ledge 22 feet above the street and were not protected from falling to the street below by any guardrail, safety net or personal fall arrest system.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around the stairway roof hatch.  Location: 428 Johnson Ave, Brooklyn, NY roof top.  On or About July 24, 2014  a). Employees working on the roof of a two story commercial project were not protected from falling into a 4 foot wide by 8 foot long opening in the roof because no guardrails, safety nets, or personal fall arrest system was not available to protect the employees.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  Location: 428 Johnson Ave, Brooklyn, NY  On or About July 24, 2014  a). Employees were working more than 20 feet above the street surface and did not recognize the hazards associated with working from those heights due to the lack of safety training by the employer. Employees utilized A frame ladders on the site in manners other than the manner for which the use was intended. Employees were accessing a metal tubular welded scaffold without the working/walking surface being fully planked between the uprights, from front to back.
