29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form. Where the employer was unable to identify or reasonably estimate the employee exposure, the employer did not consider the atmosphere to be IDLH (Immediately Dangerous to Life or Health). a. On or about 7-24-14, the employer did not evaluate the employee exposure to respiratory hazards associated with nitrogen. The nitrogen in the facility led to an oxygen level of 17.4 percent in the changing room, which is below the IDLH minimal acceptable limit of 19.5 percent oxygen in the air. b. On or about 7-24-14, the employer did not evaluate the employee exposure to respiratory hazards associated with nitrogen. The nitrogen in the facility led to an oxygen level of 18.4 percent in the break room, which is below the IDLH minimal acceptable limit of 19.5 percent oxygen in the air. c. On or about 7-24-14, the employer did not evaluate the employee exposure to respiratory hazards associated with nitrogen. The nitrogen in the facility led to an oxygen level of 19.0 percent in the processing area, which is below the IDLH minimal acceptable limit of 19.5 percent oxygen in the air.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met. On or about 7-24-14, the employer failed to develop and implement a written hazard communication program. Hazardous chemicals on site included liquid nitrogen which when used in the facility evaporated into nitrogen gas.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area. On or about 7-24-14, in the processing area, the employer allowed employees to work around liquid nitrogen and nitrogen gas without providing them training on those chemicals.
