29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    On or about July 29, 2014, at 5025 Easton Road, Saint Joseph, Missouri 64507:    In and around the vibratory deburing machine, employees were exposed to noise levels equal or exceeding an 8 hour time-weighted average of 85 decibels measured on the A scale, or equivalently a dose of fifty percent and an effective hearing conservation program was not implemented.    (a) A robotic welder operator was exposed to 74.8% dose of the allowable 8 hour time weighted average sound level of 90 dBA or an equivalent 8 hour time weighted average sound level of approximately 87.9 dBA during a 455 minute sampling period on 07/29/14. Zero exposure was assumed for the remaining unsampled portion of the 8 hour shift.    (b) A vibratory deburing operator was exposed to 162.6% dose of the allowable 8 hour time weighted average sound level of 90 dBA or an equivalent 8 hour time weighted average sound level of approximately 93.5 dBA during a 457 minute sampling period on 07/29/14. Zero exposure was assumed for the remaining unsampled portion of the 8 hour shift.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines, whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.    (a) CNC room; Employees were exposed to amputation hazards caused when the CNC machine interlocks were disengaged. This allowed employees to open the CNC doors during machine operation. Many CNC machines were operating with the interlocks disengaged.
