Nor did he adequately select necessary personal protective equipment (PPE) to protect the employees.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:      (a) No written respiratory protection program had been developed.  Workers performing spray painting were required to use a tight-fitting elastomeric air purifying respirator.  Various paints were sprayed including, but not limited to, Hetrolac and Turbo-Coat.       (b) No worksite-specific procedures have been developed for respirator filter cartridge change-out schedule.     (c) No medical evaluation procedures, in accordance with section (e) of this standard have been provided to assure that respirator users were physically able to use the respirator.      (d) No fit test procedures, in accordance with section (f) of this standard, have been provided.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    (a) Machine operators were observed making cuts on the Altendorf Table Saw  without a guard in place, which potentially exposed these workers to an amputation hazard.    (b) Machine operators used the Grizzly 1.5 HP Shaper (Model G1035, SN 13477736), table router, to shape edges on fabricated plastic composite parts.  This machine was not equipped with any guarding, which potentially exposed these workers to an amputation hazard.

29 CFR 1910.212(a)(3)(ii): Point of operation guards were not designed and constructed as to prevent the operator from having any part of their body in the danger zone during the operating cycle:     (a) The employer did not ensure that the Whirlwind chop saw (model #212L, serial #1811728L) had sufficient point of operation guarding in that employees' fingers and/or hands could become trapped under the hood guard and contact the saw blade. Employees were exposed to amputation hazards.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:     (a) On July 25, 2014, In the Paint Shop, the dip tank containing a mixture of Hetrolac 105 Resin (major ingredients: toluene and methyl ethyl ketone) and Kean Strip Lacquer Thinner (major ingredients: methanol and acetone) was observed to be labeled with Hazardous Materials Identification System (HMIS)-type labels.  However, this labeling system was not described or referenced in the employer's written hazard communication program.  Hazards of this mixture of substances included, but were not necessarily limited to, flammability, potential effects on the central nervous system, and irritation effects to the eyes, skin, and respiratory tract.
