29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: Lot 16: On or about June 18, 2014 and at times prior thereto, operators were not currently trained to operate the Case backhoe 590 Super M. The employer did not provide training records on instructing employees in recognition and avoidance of unsafe conditions associated with the backhoe used to dig and move dirt off the road. Lot 16: On or about June 18, 2014 and at times prior thereto, operators cab seat insulation was severely damaged, exposing sharp metal edges where the operator sat unevenly when he swiveled or travelled around the jobsite digging and moving dirt. The employer did not instruct employees in recognition and avoidance of unsafe conditions in the cab associated with the backhoe.
