29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. A. Fairchild Construction LLC worksite located at 7915 Iron Horse Rd., Monclova, Ohio: On or about July 24, 2014, the employer did not ensure employees were protected from falls while installing the rim board on the first floor deck of the two story residential structure. The employees were exposed to a fall distance of approximately 9.50 feet on the south side of the structure.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other for which they were designed. A. Fairchild Construction LLC worksite located at 7915 Iron Horse Rd., Monclova, Ohio: On or about July 24, 2014, the employer failed to ensure a 8 ft A-framed stepladder was opened during use. The ladder was closed and leaning against the structure during use. An employee was using the ladder in the aforementioned condition during framing operations and was potentially exposed to a fall due to an unstable ladder.
