OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) Parking Lot - On or about 07/24/2014, a worker occupying an elevated articulating boom platform was not provided with or wore a body belt and lanyard while painting a commercial sign. b) Parking Lot - On or about 07/14/2014, workers assigned to operate an aerial lift having an articulating boom platform were not provided with operator training before being required to use the lift as part of a maintenance operation. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.132(f)(1): The employer did not provide training to each employee who is required by this section to use personal protective equipment: a) Parking Lot - On or about 07/24/2014, workers using an articulating boom platform as part of a painting operation were not trained in the use of personal protective equipment, including, but not limited to, a body belt and lanyard, which is required safety equipment by the articulating boom platform's manufacturer.
