29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a) A guard was not provided on the ten inch trim saw to prevent employee access to an ingoing nip point on a chain drive, which resulted in an amputation. (b) A guard was not provided on the ingoing nip point created by the conveyor on the Smith Band Saw. Abatement verification was provided by the employer for both items.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a) An employee was observed operating a powered industrial truck without wearing the seat belt provided. It was determined that the employer had not full filled the training requirements for a complete forklift training program. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19
