(a) Dry Kiln - On or about July 23, 2014 the employer did not maintain a Hyster 155 XL2 Forklift serial no. F006V01614Y in a safe condition. This forklift was operated with 1) two worn rear tires, 2) a brake system with missing parts 3) a cracked radiator water bottle 4) fire extinguisher not fully charged.

All vehicles shall be equipped with brakes capable of holding and controlling the vehicle and capacity load upon any incline or grade over which they may be operated. (a) Dry Kiln - On or about July 23, 2014 employees were exposed to a struck by hazard due to a Hyster 155 XL2 Forklift serial no. F006V01614Y having a defect brake system. The brake handle was disconnected and replaced with vise grip pliers.

29 CFR 1910.253(b)(4)(iii): Oxygen cylinders in storage shall be separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one-half hour. (a) Plainer Building - On or about July 23, 2014 employees were exposed to a fire hazard due to oxygen and acetylene bottles being stored together on a cart. The oxygen bottle was stored in direct contact with a fuel gas cylinder.
