OSH ACT of 1970 Section (5)(a)(1):    The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to:   a) On or about 07/23/14 at the employer's truck parking area on River Road in Scottsville, NY - employer failed to protect employees from caught between hazards when the back-up alarm on the 1993 International brand rear loading compacting truck was not operational.   b) On or about 07/23/14 at the employer's truck parking area on River Road in Scottsville, NY - employer failed to protect employees from caught between hazards when the back-up alarm on the 1996 Mac Packer was not operational.    Among other methods, several feasible and acceptable abatement methods to correct this hazard include following the American National Standard (ANSI) Z245.1-2008, Environmental Industry Associations standard for Mobile Wastes and Recyclable Materials Collection, Transportation, and Compaction Equipment - Safety Requirements:   1) Section 7.2.13.2 which states an external audible warning system signal device ( back-up alarm ) shall be provided on all motor vehicles.   2) Section 6.1.5 which states " that all required safety features are operational and functioning, and repairing, prior to placing equipment into service, any reported malfunction or defect that affects the safe operation of the equipment."   ABATEMENT DOCUMENTATION REQUIRED    LT Disposal was previously cited for a violation of this occupational safety and health standard or its equivalent standard OSH ACT of 1970 Section (5)(a)(1), which was contained in OSHA inspection number 865763 , Citation  1, Item 1 and was affirmed as a final order on 02/28/14, with respect to a workplace located at 119 River Road, Scottsville, NY.
