29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) Galleria Mall, York, Pennsylvania - An employee worked in a trench that was 5 feet 5 inches deep with no ladder or other safe means of egress on or about July 30,2014. No abatement certification or documentation required.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) Galleria Mall, York, Pennsylvania - An employee worked in the east side of the trench, with type c soil, to install new sanitary sewer piping. The trench where the employee worked had a depth of 5 feet 5 inches, had vertical side walls, and had no cave-in protection on or about July 30, 2014. (b) Galleria Mall, York, Pennsylvania - An employee worked in the west side of the trench, with type c soil, to install new sanitary sewer piping. The trench where the employee worked had a depth of 7 feet 5 inches, had vertical side walls, and had no cave-in protection on or about July 30, 2014. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
