29 CFR 1910.95(d)(1): A representative monitoring program was not developed and implemented when information indicated that an employee's exposure may equal or exceed an 8-hour time-weighted average of 85 dBA: (a) The employer was provided audiometric test results, which indicated that employees suffered hearing standard threshold shifts in 2010, 2011 and 2012. The employer did not develop a monitoring program exposing employees' to hearing loss on or about 8/28/2014.
