OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck by hazards when they were required to work around damaged storage racks. On or about July 31, 2014, employees were exposed to struck-by hazards when they were required to work around storage racks that were damaged. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d)

29 CFR 1910.178(l)(4)(i): Refresher training, including an evaluation of the effectiveness of that training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely. The employer failed to hold training, refresher training and an evaluation of the training, required for the operators of PIV's. This exposes employees to untrained PIV operators. Abatement documentation is not required.
