29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily: a) Warehouse Area- On or about July 21, 2014, the employer failed to ensure all powered industrial vehicle(s), such as the Clark Forklift, Serial #TMG248-0780-9570KF, were examined prior being placed into service on a daily basis. b) Warehouse- The employer failed to ensure all powered industrial vehicles, such as but Vestil Stacker Powered Industrial Vehicle, Serial #090831, were examined prior being placed into service. c) Warehouse Area- On or about July 21, 2014, the employer failed to ensure that all powered industrial vehicles that showed any condition that could adversely affect the safety of the vehicle, such as a malfunctioning horn on the Clark Forklift, Serial #TMG248-0780-9570KF, were not placed into service. No abatement certification or documentation is required for this item.

29 CFR 1910.334(a)(3)(ii): Attachment plugs and receptacles were connected or altered in a manner which prevented proper continuity of the electric equipment grounding conductor at the point where plugs were attached to receptacles: a) Warehouse Area- The employer failed to ensure that all pieces of portable electrical were equipped with a means of grounding the electrical circuit through the use of a grounding pin. Equipment, such as the Vestil Stacker Powered Industrial Vehicle, Serial #090831, was observed with a plug attachment that was missing the grounding pin. No abatement certification or documentation is required for this item.
