OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: On or about July 30, 2014, an employee was exposed to crushing hazards while operating a Bobcat E35 compact/mini excavator during site preparation without utilizing the seat belt provided by the manufacturer. Among other methods, one feasible and acceptable means of abatement includes, but is not limited to, ensuring that operator(s) of the Bobcat E35 have read and understand the safety and operation instructions in the manual prior to operation, and utilize the seat belt provided during operation, as specified by the Bobcat E-35 operation and maintenance manual.
