29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a. Located at 2600 Fisher Road in Columbus, Ohio, employees were entering and exiting an 8 foot trench shield with an 8 foot ladder without having the required three feet extending above the upper landing surface, thereby exposing the employees to a fall hazard at a maximum height of 8 feet.

29 CFR 1926.652(c)(3)(iii): At least one copy of the tabulated data, which identifies the registered professional engineer who approved the data, shall be maintained at the jobsite during construction of the protective system. After that time the data may be stored off the jobsite, but a copy of the data shall be made available to the Secretary upon request. a. Located at 4600 Fisher Road in Columbus, Ohio, employees were required to connect 8 inch sewer lines in a trench shield that was used as cave-in protection in Type C soil. The employer failed to maintain tabulated data on site during the construction of a protective system.
