OSH ACT of 1970 Section (5)(a)(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm to employees in that employees were exposed to entrapment and/or struck-by hazards while employees were operating motorized equipment:   At the job site of 5056 N. Lycee, Bel Aire, Kansas, LMT Construction employees operating equipment were exposed to entrapment and/or struck-by hazards in that seatbelts were not in use:   a) White skid steer with forks (Model Bobcat T320 Track)   b) Yellow all-terrain forklift (Model TH83 Serial 7BJ56996)   Feasible and acceptable methods to abate this hazard includes but is not limited to: Ensure compliance with American Society of Mechanical Engineers (ASME) B56.1-1993, paragraph 5.3.19 which states "An active operator protection device or system, when provided, shall be used."

29 CFR 1910.178(l)(1)(ii):This provision is applicable to construction employment by 29 CFR 1926.602(d).   29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck:  At the job site of 5056 N. Lycee, Bel Aire, Kansas, LMT Construction employees engaged in attaching new doors, windows, and siding to the exterior of the apartment complex were exposed to struck by hazards from the forklift (Model TH83 Serial 7BJ56996).  Employees who operated the forklift had not completed a training program to ensure they had the understanding and skills to operate it safely.

Lycee, Bel Aire, Kansas, LMT Construction employees engaged in attaching new doors, windows, and siding to the exterior of the apartment complex were exposed to struck by hazards from the skid steer with forks (Bobcat T320 Track). Employees were not provided safety information and training on the worksite job tasks nor was there a designated person, qualified as competent, to oversee the safety of the jobsite, materials, and equipment.

Lycee, Bel Aire, Kansas, LMT Construction employees engaged in attaching new doors, windows, and siding to the exterior of the apartment complex were exposed to eye injuries.  Employees used pneumatic nailers (Bostitch N66C-2-E Pneumatic Coil Nailer) and circular saws (Makita 7-1/4" Model- 5007NB) and did not wear safety glasses.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge 6 feet or more above a lower level was not protected from falling by the use of a guardrail system, safety net system, or personal fall arrest system.   At the job site of 5056 N. Lycee in Bel Aire, KS, LMT Construction employees engaged in attaching new doors, windows, and siding to the exterior of the apartment complex were exposed to fall hazards of approximately 10 feet from the balcony to the ground below. The 2x4s used as guardrails were removed when employees installed siding and doors on the balconies.

At the job site of 5056 N. Lycee, Bel Aire, Kansas, LMT Construction employees engaged in attaching new doors, windows, and siding to the exterior of the apartment complex were exposed to fall hazards of approximately 10 feet from the balcony to the ground below. Fall hazard training was not provided to the employees to ensure they were aware of the hazards of working on the balcony level and the fall protection methods to minimize the hazards.
