29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:   (a)  New Mill - On or about April 23, 2014 the guardrail for the walkway at the chipper did not have a midrail.   (b)  New Mill - On or about April 23, 2014 the opening at the carriage and the edger did not have a standard guardrail. Employees were exposed to falling 9 feet to a lower level.   (c)  Old Mill - On or about April 23, 2014 a 12 feet wide opening on both side at the chipper did not have a standard guardrail.

29 CFR 1910.95(c)(1): A continuing, effective hearing conservation program as described in 29 CFR 1910.95 (c) through (o) was not instituted when employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels:   (a) Job Site - On or about April 23, 2014 an employee working at the Edger was exposed to continuous noise at 166.5% of the permissible daily noise (8-hour time- weighted average sound level of 90 dB) or an equivalent sound level of approximately 96 dBA during the 273 minute sampling period on 04/23/14.  Exposure calculations included a zero increment for the time not sampled.   (b) Job Site - On or about April 23, 2014 an employees working at the Chipper was exposed to continuous noise at 339% of the permissible daily noise (8-hour time- weighted average sound level of 90 dB) or an equivalent sound level of approximately 98 dBA during the 272 minute sampling period on 04/23/14.  Exposure calculations included a zero increment for the time not sampled.
