29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, failure of protective systems or other hazardous conditions: (a) Excavation in the vicinity of 1031 W. Clairemont Avenue, Eau Claire, WI, Gordy's gas station project; The daily inspection of the trench was not conducted by a competent person as the employees were working in an unprotected excavation without adequate cave in protection. The competent person did not display effective knowledge of safe excavation requirements and employees were working in an excavation that had soil falling from the edges.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): (a) Excavation in the vicinity of 1031 W. Clairemont Avenue, Eau Claire, WI, Gordy's gas station project; Employees were unprotected while working in an excavation that did not have adequate cave-in protection systems. The excavation was approximately 16 feet deep with an excavated face that was sloped at 44 to 46 degrees in class C soil.
