29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): This employer is failing to ensure employees are protected from falling greater than 6 feet in height during the course of work on elevated surfaces. This violation was most recently observed at a work located at 118 N. Ashley Park, Wichita, KS 67212, where employees were observed working from a roof surface of a residential structure, without the use of fall protection to prevent a fall greater than six feet to the ground below. Adrian Torres dba A & E Roofing was previously cited for a Repeat Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926. 501(b)(13), which was contained in OSHA inspection number 315085373, citation number 2, item number 1 and was affirmed as a final order on 04/22/11, with respect to a workplace located at 1311 City View, Wichita, KS 67209.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. The employer is failing to provide instruction to employees in recognizing and eliminating fall hazards at heights above six feet. This violation was most recently observed at a work site located at 118 N. Ashley Park, Wichita, KS 67212, where employees were exposed to falling greater than six feet, while working from a roof surface, without being provided instruction in how to recognize and eliminate those hazards.
