29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck was dismounted and within 25 feet of the truck still in his view, the load engaging means were not fully lowered, controls neutralized, and the brakes set to prevent movement: On or about August 04, 2014, the employer did not ensure that employees operating the Datsun PFG02 Forklift set the parking brake to prevent movement, exposing employee to the hazard of being struck by the free moving forklift.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition: On or about August 04, 2014, and at times prior thereto, the employer did not take the Datsun PGF02 forklift out of service when it was unsafe for operation, the forklifts propane fuel tank was not secured to the forklift.
