29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. Drill Site: On or about July 31, 2014, and at times prior thereto, one employee was operating an all-terrain forklift without a working hand brake and no seat belt. This condition exposed the employee to potential struck-by and fall hazards.
