OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed-by hazards created by the use of industrial storage racks that were damaged and not anchored to the floor.      a) Warehouse, 100 Romeo Lane, Uniontown, PA 15401:  Observed on or about July 30, 2014, the industrial storage rack designated I0-00-14 was not anchored to the floor, was missing a cross brace, and was equipped with a bent column.  The damaged industrial storage rack was at risk of collapsing or tipping over while being loaded and unloaded by a Hyster forklift.  Employees working in the area of the damaged industrial storage rack were exposed to crushed-by hazards.    b) Warehouse, 100 Romeo Lane, Uniontown, PA 15401:  Observed on or about July 30, 2014, the industrial storage rack designated B0-00-09 was not anchored to the floor and was equipped with a bent column.  The damaged industrial storage rack was at risk of collapsing or tipping over while being loaded and unloaded by a Hyster forklift.  Employees working in the area of the damaged industrial storage rack were exposed to crushed-by hazards.    c) Warehouse, 100 Romeo Lane, Uniontown, PA 15401:  Observed on or about July 30, 2014, the industrial storage rack designated A18-00 was not anchored to the floor, was missing a cross brace, and was equipped with a bent column.  The damaged industrial storage rack was at risk of collapsing or tipping over while being loaded and unloaded by a Hyster forklift.  Employees working in the area of the damaged industrial storage rack were exposed to crushed-by hazards.    d) Warehouse, 100 Romeo Lane, Uniontown, PA 15401:  Observed on or about July 30, 2014, the industrial storage rack located in aisle "A" in front of cola machine and light bulb changing platform was not anchored to the floor, was missing a cross brace, and was equipped with a bent column.  The damaged industrial storage rack was at risk of collapsing or tipping over while being loaded and unloaded by a Hyster forklift.  Employees working in the area of the damaged industrial storage rack were exposed to crushed-by hazards.

29 CFR 1910.29(a)(3)(iii):  The supporting structure for the work level was not rigidly braced, using adequate cross bracing or diagonal bracing with rigid platforms at each work level:      a)  Freezer area, 100 Romeo Lane, Uniontown, Pennsylvania 15401:  Observed on or about July 30, 2014, a Cotterman brand ladder stand used to access higher shelves in the freezer was not rigidly braced, using adequate cross bracing or diagonal bracing.  The structural stability of the ladder stand was compromised by broken tube members located at the base of the ladder stand.  Employees using the ladder stand to access upper levels of industrial storage racks in the freezer were exposed to a fall hazard of approximately 7 feet to the concrete floor below.
