Section 5 (a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from flash fires and explosions: (a) On or about July 18, 2014, for the employee who suffered burns from a flash fire while working near a diesel-powered pumping unit located approximately 13 feet from a frac tank where hydrocarbons were off gassing located at the BOE STATE 31X-16D well site, Williston, ND. Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard would be to ensure that: 1. "Discharges of oil or gas to the atmosphere should be to a safe area, preferably on the downwind side of the well and a minimum of 100 feet (30.5 m) from the wellhead, open flame, or other sources of ignition.", as described in Section 12 of the American Petroleum Institute - Recommended Practice 54, Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations. 2. "No sources of ignition should be permitted in an area where smoking has been prohibited." , as described in Section 7 of the American Petroleum Institute - Recommended Practice 54, Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations.
