Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:   a) In Shop 3, on Aug 4, 2014 and at times prior thereto; an employee used a Hyster 60 forklift to elevate an employee approximately 9 feet high, to weld on an exterior seam of a steel tank they were constructing. The employee utilized a shop made man basket as a work platform. The platform was not secured to the forks and fall protection was not provided.
