29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about August 5, 2014 and at times prior thereto, at this excavation site, employees working in a trench over 5 feet deep were not trained in the following: A. Employees who were required to enter and work in trenches and excavations were not trained in how to recognize hazardous conditions. B. The employer had not trained the person designated as the competent person for trenching and excavation operations what to do as a competent person.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): On August 5, 2014 and at times prior thereto, employees entered a vertical wall trench over 5 feet deep to connect to a manhole. The vertical walls were not shored or protected to prevent a cave-in.
