29 CFR 1915.73(d): When employees were exposed to unguarded edges of decks, platforms, flats, and similar flat surfaces, more than 5 feet above a solid surface, the edges were not guarded by adequate guardrails meeting the requirements of 1915.71(j)(1) and (2), unless the nature of the work in progress or the physical conditions prohibit the use or installation of such guardrails:  (a) USS Boxer (LHD-4), Flight Deck Area, Cargo and Weapon's Elevator: On July 31, 2014, employees were laying down tape on an elevator platform that did not have guardrail protection. Employees were exposed to fall hazards of up to 98 feet resulting in death.   (b) USS Boxer (LHD-4), Flight Deck Area, Cargo and Weapon's Elevator: On July 30, 2014, employees were applying primer to an elevator platform that did not have guardrail protection. Employees were exposed to fall hazards of up to 98 feet.  (c) USS Boxer (LHD-4), Flight Deck Area, Cargo and Weapon's Elevator: On July 29, 2014, employees were removing non-skid paint on an elevator platform that did not have guardrail protection. Employees were exposed to fall hazards of up to 98 feet.  (d) USS Boxer (LHD-4), Flight Deck Area, Cargo and Weapon's Elevator: On July 22, 2014, two employees were installing plastic containment inside an elevator platform that did not have guardrail protection. Employees were exposed to fall hazards of up to 98 feet.

29 CFR 1915.77(d): For work performed in restricted quarters at least 20 inches wide meeting the requirements of 1915.71(i)(1) was not used to afford proper protection against falling:  (a) USS Boxer (LHD-4), Flight Deck Area, Cargo and Weapon's Elevator: On July 31, 2014, employees were laying down tape on an elevator platform that did not have guardrail protection. Employees were exposed to fall hazards of up to 98 feet resulting in death. 29 CFR 1915.152(b): The employer did not assess work activity to determine whether hazards are present, or likely to be present, which necessitate the employee's use of personal protective equipment (PPE):    (a) USS Boxer (LHD-4), Flight Deck Area, Cargo and Weapon's Elevator: On July 31, 2014, the employer failed to conduct a hazard assessment to determine the existence of fall hazards. Employees were exposed to falls up to 98 feet while applying masking tape to the elevator platform without the use of a personal fall arrest system.   (b) USS Boxer (LHD-4), Flight Deck Area, Cargo and Weapon's Elevator: On July 30, 2014, the employer failed to conduct a hazard assessment to determine the existence of fall hazards.  Employees were exposed to falls up to 98 feet while applying primer paint to the elevator platform without the use of a personal fall arrest system.   (c) USS Boxer (LHD-4), Flight Deck Area, Cargo and Weapon's Elevator: On July 29, 2014, the employer failed to conduct a hazard assessment to determine the existence of fall hazards.  Employees were exposed to falls up to 98 feet while removing non-skid paint on the elevator platform without the use of a personal fall arrest system.    (d) USS Boxer (LHD-4), Flight Deck Area, Cargo and Weapon's Elevator: On July 22, 2014 the employer failed to conduct a hazard assessment to determine the existence of fall hazards.  Employees were exposed to falls up to 98 feet while installing plastic containment inside the elevator platform without the use of a personal fall arrest system.
