OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush hazards while operating an industrial truck without a seatbelt:   (a)  Facility Wide:  On August 7, 2014 and at times prior to; the employer exposed employees to crush hazards in that employees were allowed to operate the YALE industrial truck that was not equipped with a seatbelt.   (b)  Facility Wide:  On August 7, 2014 and at times prior to; the employer exposed employees to crush hazards in that employees were allowed to operate the TAYLOR (Yellow) industrial truck that was not equipped with a seatbelt.   (c)  Facility Wide:  On August 7, 2014 and at times prior to; the employer exposed employees to crush hazards in that employees were allowed to operate the TAYLOR (Red) industrial truck that was not equipped with a seatbelt.

(b)  On the south end of the main branch:  On August 7, 2014 and at times prior to; the employer exposed employees to being struck-by the load or parts of a collapsing crane that had not been load tested.  (c)  In the west wing:  On August 7, 2014 and at times prior to; the employer exposed employees to being struck-by the load or parts of a collapsing crane that had not been load tested.

29 CFR 1910.254(b)(4)(iii): Input power terminals, tap change devices and live metal parts connected to input circuits were not completely enclosed and accessible only by means of tools:  (a)   Along the east wall, north end:  On August 7, 2014 and at times prior to; The employer exposed employees to electrical shock hazards from the Lincoln TM-500, AC welder in that the connecting terminal for the welding lead was not protected.  (b)  Along the east wall, center:  On August 7, 2014 and at times prior to; The employer exposed employees to electrical shock hazards from the Lincoln TM-250, DC welder in that the connecting terminal for the welding lead was not protected.  (c)  Along the east wall south end:  On August 7, 2014 and at times prior to; The employer exposed employees to electrical shock hazards from the Lincoln TM-500, AC welder in that the connecting terminal for the welding lead was not protected.  (d)  Along the east wall in the west wing:  On August 7, 2014 and at times prior to; The employer exposed employees to electrical shock hazards from the Lincoln TM-500, AC welder in that the connecting terminal for the welding lead was not protected.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:  (a)  Facility Wide: On August 7, 2014 and at times prior to; the employer failed to ensure that employees received training during formal instruction, as required by this paragraph in that there was no video tape or written material and there was no practical exercise.

29 CFR 1910.305(b)(1)(i): Conductors entering cutout boxes, cabinets, or fittings were not protected from abrasions:  (a)  On the northeast corner of the west wing:  On August 7, 2014 and at times prior to; The employer exposed the employees to hazards associated with arc flash and fires in that the electrical panel, that was mounted on a plywood sheet, did not protect conductors from abrasions.
