29 CFR 1926.100(a): Employee working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about August 7, 2014, an employee was exposed to a struck by hazard to the head while not wearing a protective helmet on 1st level of scaffold while inspecting the work being done directly overhead on the 2nd level of the scaffold.

29 CFR 1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below:   On or about August 7, 2014, an employee was exposed to being struck by items such as bricks from employees laying bricks on the second level of the scaffold overhead, while employee was inspecting work from the first level of a scaffold that did not have toeboards installed.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames,  or uprights did not bear on base plates, mud sills or other adequate firm foundation:  On or about August 7, 2014, employees were exposed to fall hazards of approximately 13 feet in height to paved ground level below when laying brick on an exterior wall on a commercial building while standing on a scaffold that had been erected with the upright support poles placed directly on the mud sills.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces were used as a means of access:    North side of a commercial building, On or about August 7, 2014, employees were exposed to falls greater than 10 feet in height to the ground level below, when working from the scaffold, which did not have a ladder for access and egress to and from the scaffold platforms, while laying brick on an exterior wall.   The TM Work Zone Masonry, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(e)(1), which was contained in OSHA inspection number 977930, citation number 1, item number 1 and was affirmed as a final order on July 2, 2014, with respect to a workplace located at 1010 North Loop 1604 East, San Antonio, TX. 78258.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms:    North side of commercial building, On or about August 7, 2014, employees were exposed to falls greater than 10 feet in height, to the ground level below, when working from a welded tubular scaffold, which was not provided with guardrails on the open end of the scaffold work platforms, while laying brick on an exterior wall.    The TM Work Zone Masonry, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(4)(I), which was contained in OSHA inspection number 977930, citation number 1, item number 2 and was affirmed as a final order on July 2, 2014, with respect to a workplace located at 1010 North Loop 1604 East, San Antonio, TX. 78258.
