OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, in that employees were exposed to amputation hazards:   a) Plant - On or about 08/08/14 and at times prior thereto employees in charge of the operation of  the two Hytrol conveyors were exposed to unprotected ingoing nip points created by the rollers, the conveyor band, and the fixed parts of the structure. The employer failed to ensure that the conveyor system was protected by guards.   b) Plant - On or about 08/08/14 and at times prior thereto the power disconnect panels  for the two Hytrol conveyors were not directly accessible during an emergency.  The employer did not ensure that the machines were equipped with emergency stop buttons, pull wires, or similar emergency stop devices.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l):  (a) Plant and  Warehouse -  On or about 08/08/14 and at times prior thereto employees operated the LPG-powered Nissan forklift, and the employer did not certify that the drivers were trained and evaluated in the safety operation of the forklifts.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) Plant - On or about 08/08/14 and at times prior thereto employees operated the packaging machine and the Nissan forklift, and came in contact  with chemicals including  (but not limited to)  compressed nitrogen cylinders and liquefied petroleum gas  (LPG) cylinders. The employer did not prepare and implement a written Hazard Communication Program.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use:  a) Plant - On or about 08/08/14 and at times prior thereto employees operated the packaging machine and the Nissan forklift, and came in contact  with chemicals including  (but not limited to)  compressed nitrogen cylinders and liquefied petroleum gas  (LPG) cylinders. The employer did not gather and did not maintain on site a copy of each Safety Data Sheet.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) Plant - On or about 08/08/14 and at times prior thereto employees operated the packaging machine and the Nissan forklift, and came in contact  with chemicals including  (but not limited to)  compressed nitrogen cylinders and liquefied petroleum gas  (LPG) cylinders. The employer did not train the employees in relation to the hazardous properties of the materials at the worksite, and the "Right to Know".   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
