(Construction Reference 1926.103)  On or about 8-6-14, on the front porch of a residence in New Orleans, LA, the employer allowed employees to use 3M tight fitting facepiece respirators while sanding lead based paint off exterior siding without fit testing the employees using the respirators.

29 CFR 1926.62(c)(1): Employee(s) were exposed to lead at concentrations greater than fifty micrograms per cubic meter of air averaged over an eight-hour period.  a. On or about 8-6-14, on the front porch of a residence in New Orleans, LA, the employer allowed employees to be exposed to a lead concentration that exceeded the 8 hour time weighted average (TWA) permissible exposure limit (PEL) of 50 micrograms per cubic meter. A worker on the porch, that was sanding lead based paint off the exterior siding of the residence in a tarp enclosure, was exposed to an 8 hour TWA concentration of 5870 micrograms per cubic meter, which is approximately 117 times the PEL. The exposure was derived from a sample taken from a 313 minute period. Zero exposure was assumed for the 167 minutes not sampled.    b. On or about 8-6-14, on the front porch of a residence in New Orleans, LA, the employer allowed employees to be exposed to a lead concentration that exceeded the 8 hour time weighted average (TWA) permissible exposure limit (PEL) of 50 micrograms per cubic meter. A second worker on the porch, that was sanding lead based paint off the exterior siding of the residence in a tarp enclosure, was exposed to an 8 hour TWA concentration of 10010 micrograms per cubic meter, which is approximately 200 times the PEL. The exposure was derived from a sample taken from a 313 minute period. Zero exposure was assumed for the 167 minutes not sampled.

29 CFR 1926.62(d)(1)(i): Each employer who had a workplace or operation covered by 29 CFR 1926.62 did not initially determine if any employee was exposed to lead at or above the action level of 30 micrograms per cubic meter of air calculated as an 8-hour time-weighted average (TWA).  On or about 8-6-14, at a residence in New Orleans, LA, the employer allowed employees to sand lead based paint off the exterior wood siding of the residence without determining what the lead exposure would be for the employees.
