29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) Work Site: 646-648 Market Street, Newark, NJ - Rear Balcony - Area By Egress Ladder Employees observed working on the rear balcony were not protected from a fall hazard. The employees were exposed to a 12'9" fall hazard as no fall protection measures were in place. Violation observed on or about 7/29/2014. b) Work Site: 646-648 Market Street, Newark, NJ Employees conducting water proofing around the walls of the roof were exposed to a 50 foot fall to the ground below, through a 36" parapet opening, as no fall protection measures were in place. Violation occurred on or about 7/29/2014.

29 CFR 1926.1052(c)(12): Unprotected sides and edges of stairway landings were not provided with guardrail systems that meet the criteria contained in Subpart M of 29 CFR 1926: a) Work Site - 646-648 Market Street, Newark, NJ - Stairway Landing at Floor 3, 4 and 5 Employees were exposed to a potential fall hazard of 43 feet from the landing to the ground below as there was an 89 inch opening on the stairway landing at each level that was not guarded to prevent a fall. Violation observed on or about 7/29/2014.
