29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment are not to be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.    On or about August 5, 2014, the employer used a rough terrain forklift to elevate a platform with an employee on it to an upper level.  The rough terrain forklift was not designed by the manufacturer to elevate people or platforms exposing the employee to a fall hazard.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.     On or about August 5, 2014, the employer did not ensure an employee working from a work platform was protected by the use of a personal fall arrest system or guardrail system, exposing the employee to a fall hazard.
