29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. The employer does not ensure that each employee on a walking/working surface with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level is not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. This violation occurred on or about August 13, 2014, at the jobsite where an employee was exposed to an approximate 11.5 foot fall hazard while working on the entrance overhang without a fall protection system. Pursuant to 29 C.F.R. 1903.19, within one (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all ladders used by employees are used for the purpose for which they were designed.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed. The employer does not ensure that a portable ladder is used for the purpose in which it is designed. This violation occurred on or about August 13, 2014, at the jobsite where an employee was exposed to a fall hazard when using a 12 foot step ladder to gain access to the upper landing surface for which it was not designed. Pursuant to 29 C.F.R. 1903.19, within one (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all ladders used by employees are used for the purpose for which they were designed.
