29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury.  On or about 8/11/2014, employees working in trenches greater than 5 feet were not trained on the hazards of working in and around trenches and excavations prior to being exposed to those hazards.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems.  On or about 8/11/14, at the 4916 N. Royal Atlanta Drive, Tucker job site, the competent person on site did not make inspections to the trench, measured six feet 6 inches deep by 8 feet by 12 feet, and make corrections to that trench prior to employees entering the trench.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).   On or about 8/11/14, at the 4916 N. Royal Atlanta Drive, Tucker Ga jobsite, employees working in a straight cut trench measuring 8 feet by 12 feet and 6 feet 6 inches deep, were not protected from cave in hazards as there was no protective system present.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
