29 CFR 1926.501(a)(2): The employer did not determine if the walking/working surfaces on which its employees were to work on, had the strength and structure integrity to support employees safely:    Location: 16 Morton Street NY, NY / 3rd floor  On or about: August 14, 2014   a) Workers were working from a surface that was part of the demolished stairwell system. As the employees were hoisting up a beam, the working surface collapsed and the employees were injured.

Location: 16 Morton Street NY, NY / 3rd floor  On or about: August 14, 2014   a) Employees were manually hoisting materials while standing on a beam with a single piece of plywood placed on top of a partially demolished stairwell system.  The work surface collapsed as employees were working on it.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  Location: 16 Morton Street NY, NY / 3rd floor  On or about: August 14, 2014  a) Employees were not trained in the recognition of fall hazards and procedures to eliminate or minimize the fall hazards. Two employees were working on a beam on the third floor and two more employees were on the second floor assisting the workers on the third floor, and they did not recognize fall hazards.

29 CFR 1926.501(b)(15): Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system:  Location: 16 Morton Street NY, NY / 3rd floor  On or about: August 14, 2014  a) Employees were hoisting materials on a beam on the third floor without any guardrail system, safety net or personal fall arrest system.  b) Employees were assisting with the hoisting of material while standing on a work surface on the second floor without any guardrail system, safety net or personal fall arrest system.  Setanta restoration Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(15), which was contained in OSHA inspection number 940548, citation number 1, item number 2 and was affirmed as a final order on 11/15/2013, with respect to a workplace located at 177 West 4 Street New York, NY 10014.
